Alabama

Legislative Summary

(1) In order to receive a license, a Home Inspector must successfully complete the following actions:

(a) File an accurate, complete, timely, and notarized application for license with the Director, along with the appropriate fee.

 

(b) Obtain bodily injury and property damage liability insurance covering the applicant’s home inspection operations in the sum of not less than $20,000 for injury or damage to property; $50,000 for injury or damage, including death, to any one person; $100,000 for injury or damage, including death, to more than one person; and $250,000 of errors and omissions coverage.

 

(c) Provide evidence of one of the following professional qualifications:

1. Membership in and adherence to the ethical standards of one of the following professional bodies at the time of application:  American Society of Home Inspectors, Inc. (ASHI), Housing Inspection Foundation, dba The Association of Home Inspectors, Home Inspection Institute, National Association of Home Inspectors, Inc., National Institute of Building Inspectors (NIBI), American Inspectors Society, Home Inspection Institute of America, Inspection Depot, Advantage Systems ASP, LLC, Inspection Technology Institute or International Society of Home Inspectors OR

 

2. Approval or certification by one of the following agencies to inspect residential construction: The United States Veterans Administration, United States Department of Housing and Urban Development, the Southern Building Code Congress International, or the Council of American Building Officials OR

 

3. A high school diploma or its equivalent, work experience for at least one year as a home inspector, and completion of at least 100 home inspections for compensation OR

 

4. Alabama licensure on or after January 1, 1998, as a general contractor, registered professional architect, registered professional engineer, or residential home builder. Renewals of home inspector licensure previously supported by evidence of an acceptable professional license shall not require the applicant to repeat proof of such professional licensing.

 

(d) Complete a written examination demonstrating to the Building Commission that the applicant possesses an appropriate understanding of the Standards of Practice (Rule 170-X-25-.01) and the Code of Ethics (Rule 170-X-25-.02) promulgated by the Building Commission and a written examination demonstrating adequate knowledge of performing home inspections. The written examination for Home Inspectors to demonstrate appropriate understanding of the Standards of Practice and Code of Ethics will be the American Society of Home Inspectors Standards and Ethics Examination. The written examination demonstrating adequate knowledge of performing home inspections will be the Examination Board of Professional Home Inspectors National Home Inspectors Examination. Applicants shall pay any and all fees associated with testing directly to the organizations conducting the testing. Applicants must present with their application, original or duplicate test score reports demonstrating that the applicant has passed both tests within ninety (90) days of submitting the application.

Alaska

Legislative Summary
There is no specific Pre-licensing Education requirement in Alaska.  Candidates must comply by doing the following:
1) pass the National Home Inspector Examination; 2) meet requirements as determined by the Dept.; 3) submit a complete app. for reg. within 1 year of passing exam; 4) not have been convicted of specific crimes in the past 7 years of the date of the application; 5) not have had the authority to perform home inspections revoked in the state or another jurisdiction; 6) not be the subject of an unresolved criminal complaint or unresolved disciplinary action in the state; 7) pay the appropriate fees. Inspector must carry insurance and a bond of over $5000.  All inspectors must be licensed by July 1, 2004.

The Dept requires at least 8 hours of continuing competency in each licensing period.

Arizona

Legislative Summary
Board of Technical Registration requires that Educational training is approved as long as the provider is licensed by the appropriate post-secondary education regulatory agency in the home state of the facility. (BTR) certifies and regulates the practice of home inspectors. The law requires 80 hours of education pass the National Home Inspector Examination and evidence of successful completion of 30 parallel inspections. Must have one of the following: 1) Errors and Omissions Insurance in the amount of $200,000 in the aggregate and $100,000 per occurrence; 2) a $25,000 bond or proof of assets in that amount, 3) an alternate financial assurance mechanism by the BTR with a value of at least $25,000.  If a home inspector loses or otherwise fails to maintain the required financial assurance, the Home Inspector certificate shall be automatically suspended.

BTR does not recognize CE's.

Arkansas

Legislative Summary
Effective 9/16/05:
80 hours of education from training course approved by the board. All Home Inspectors must register with the Arkansas Home Inspector Registration Board. Applicants must pass the National Home Inspector Examination. Home Inspectors prohibited from making repairs on properties they have inspected within the last 12 months. Must have general liability insurance of at least $100,000.

14 Hours CEC per year. No more than 4 hours can be from a home study, online, or correspondence course. Up to 10 hours of CECs may be carried over to the following year. 
(Correspondence and online courses are not acceptable for pre-licensing education).

California

Legislative Summary

California home inspectors are not required to be licensed. The California 
Business & Professions Code defines a home inspection as a “a noninvasive,
physical examination, performed for a fee in connection with a transfer, as
defined in subdivision (e), of real property, of the mechanical, electrical,
or plumbing systems or the structural and essential components of a
residential dwelling of one to four units designed to identify material
defects in those systems, structures and components.” The complete text is

California home inspectors are prohibited from performing any repair work on
a property they have inspected within the prior 12 months. In 10 of the last

Connecticut

Legislative Summary
Connecticut Licensure (Chapter 400F enacted in 1999) - Connecticut law requires home inspectors to be licensed: 1) have successfully completed high school or its equivalent; 2) have either been a home inspector intern one year and performed 200 inspections for compensation or taken our program and earned an intern permit, and performed 100 inspections; 3) have passed an oral, written, or electronic competency exam; 4) have paid a $200 fee. (Intern permit similar, but with $100 fee.) Pre-licensing courses must meet a minimum of 40 hours. Minimum 20 CEC hours for each 2 year period, at least 3 CEC hours must be in legislation.

Florida

Legislative Summary                             

State of Florida :
Senate Bill 2234, enacted June 27, 2007 as Chapter 468, Part XV, Florida Statutes, Provides for licensure and regulation of home inspectors. Chapter 468, Part XV, Florida Statutes, became effective July 1, 2010, and provides that the home inspector licensing program will be administered by the Department of Business and Professional Regulation. There is not a Board of Home Inspectors. The department administers the licensure and regulation functions for this profession.

Grandfathering Clause:  On July 1, 2010, the Department of Business and Professional Regulation began its licensing and regulation of home inspectors and mild related services. Applications with instructions and requirements are available on the DBPR website at:

There are two methods of licensure by grandfathering:

1. If the applicant is certified as a home inspector by a state or national association that requires successful completion of a proctored examination on home inspection services and completion of at least 14 hours of verifiable education on such services;

or

2. At the time of application, the applicant has at least three years of experience as a home inspector and completion of at least 14 hours of verifiable education on home inspection services. To establish the 3 years of experience, an applicant must submit at least 120 home inspection reports prepared by the applicant. The department may investigate the validity of a home inspection report.

Only option #2 requires 120 inspection reports.

If you are applying for licensure using option #2 and submitting the required 120 home inspection reports, the reports have to be submitted by hard copy on paper. The department cannot accept an electronic version at this time. In addition, if any confidentiality issues exist, the applicant can redact information on the reports they do not wish to make public record. County of Charlotte:

There are specific home inspection requirements in the county of Charlotte in Florida. To become a home inspector, applicants must meet one of the following requirements:

  1. The applicant currently possesses an active FL license as a professional Engineer, Architect, General Contractor, Building Contractor, Residential Contractor, Building Code Administrator or Building Official or has maintained one or more of the above licenses for a combined total of 4 years during the 10-year period immediately preceding the application;
  2. The applicant (1) currently possesses and active FL license as a Building Code Inspector or Building Inspector or has maintained one pr more of the above licenses for a combined total of 4 years during the 10-year period immediately preceding the application, and (2) has obtained a grade of 75% or better on the ASHI exam;
  3. The applicant (1) has produced proof satisfactory to the board that he or she has 3 years of experience in a Building Trade or as a home inspector or a combined total of 3 years in those fields, and (2) has obtained a grade of 75% or better on the NHIE

Legislative Summary

CURRENT LAW
Georgia Trade practice act (Chapter 3, Title 8) enacted in 1994. Law requires them to provide written docs with certain info.: 1) must include the scope of the inspection; 2) include structural elements and the systems to be inspected; 3) state that it is a visual inspection; 4) that they will notify the person in writing of any defects; No Education or CE requirements.

Illinois

Legislative Summary
Candidates must:  be at least 21 years of age; show proof of a high school diploma or equivalent; successfully complete 60 hours of education by an education provider approved by DFPR; take and successfully pass a state exam.

Section 1410.160 Continuing Education Requirements

a) A home inspector who makes application to renew his or her Home Inspector License shall successfully complete the equivalent of 6 hours per year of approved continuing education persuant to Subpart F, preceding the renewal; For example, a total of 12 hours of approved continuing education must be completed during each 2 year renewal cycle. A minimum of 6 hours of continuing education must be approved as mandatory courses, as defined by Subpart F.

b) If a home inspector was issued an initial license for less than one year prior the the expiration of the license, no continuing education is required for that renewal. If a home inspector has held a license for more than one year prior to the expiration, but less than two years, 6 hours of approved continuing education is required. A mminimum of 3 hours of continuing education must be approved as mandatory courses as defined by Subpart F.

C) Continuing education may be obtained anytime during the pre-renewal period.

Indiana

Legislative Summary

Effective May 18, 2005
1.) Be at least eighteen (18) years of age;  2.) Have graduated from high school or have earned a GED;
3.) Have not been convicted of a crime or act that would prohibit you from obtaining the license;  4.) Complete a pre-licensing course of at least sixty (60) hours provided by a Board-approved course provider (NOTE: Of the 60 hour educational requirements,  a minimum of 40 hours need to be of classroom (study or lecture) training and 12 hours or practical experience .The balance may consist of classroom, home study, or practical experience.) ** Kaplan's Residential Home Inspection & Fast Track Home Inspection Courses meet these requirements.**  5.) Pass the National Home Inspector Examination as provided by the Examination Board of Professional Home Inspectors;  6.) Submit proof of having minimum insurance liability coverage of one hundred thousand dollars ($100,000); and 7.) Pay the application/license issuance fee of four hundred fifty dollars ($450).

For renewal, the Board requires the below Continuing Education.

* A licensed home inspector is required to complete 32 hours of continuing education for each renewal cycle that is 24 months or more
* A licensed home inspector who has had their license for less than 24 months but more than 12 months is required to complete 16 hours of continuing education.
* A licensed home inspector who has had their license for less than 12 months is not required to complete any continuing education for this cycle.

Kansas

Legislative Summary
On May 18, 2008, Gov. Sebelius signed HB 2315 requiring all home inspectors practicing in the state of KS to be registered.  As of July 1, 2009, all home inspectors practicing in counties with a population of 60,000 or more must have:

 

-          A high school diploma (or equivalent) and be at least 18 years of age

-          Proof of General Liability Insurance coverage of at least $100,000

-          Proof of Errors & Omissions Insurance (or similar fiscal responsibility) of at least $10,000.

-          Proof of membership in good standing in one of the nationally recognized home inspection organizations (TBD by the board by January 1, 2009).

-          Have passed a proctored exam by a testing organization approved by the board.

-          And have done one of the following options prior to May 18th, 2009:

o         Completed an 80 hour classroom course on home inspections

o         For inspectors operating in counties with populations of 60,000, have been in business for two years and completed 100 fee-paid inspections.

 

-          For inspectors operating in counties with populations of less than 60,000, have been in business for two years and completed 35 fee-paid inspections.

o         Inspectors working in counties of 60,000 or less have an additional 18 months to meet these qualifications (till January 1, 2011).

 

Once licensed, home inspectors must obtain a minimum of 16 hours of continuing education each year.

Kentucky

Legislative Summary
Effective date 7/01/2006,
(1) An individual shall not advertise or claim to be a licensed home inspector and shall not conduct a home inspection for compensation without first obtaining a license as a home inspector. (2)The board shall deny a license to any applicant who fails to: (a) Furnish evidence satisfactory to the board, showing that the individual:1. Is at least eighteen (18) years of age; 2. Has graduated from high school or earned a Kentucky or other state'sgeneral educational development (GED) diploma; and 3. Meets other criteria established by the board; (b) Verify the information submitted on the application form; (c) Complete a board-approved training program of 64 hours involving the performance of home inspections and pass an exam prescribed or approved by the board; (d) Submit to the board a certificate of insurance that is acceptable to the board and that: 1. Is issued by an insurance company or other legal entity authorized to transact insurance business in Kentucky; 2. Provides for general liability coverage of at least two hundred fifty thousand dollars ($250,000); 3. Lists the Kentucky Board of Home Inspectors as a certificate holder of any insurance policy issued under this paragraph; 4. States that cancellation and non renewal of the underlying policy is not effective until the board receives at least ten (10) days' prior written notice of the cancellation or non renewal; and 5. Contains any other terms and conditions established by the board; or(e)Pay appropriate licensing fee.

A total of 130 hours of pre-licensing education is required. A) At least 90 hours of classroom education. B) At least 30 hours of infield/hands on training from a board approved In-Field Training Provider. C) Live training shall consist of 10 live home inspections with a qualified infield trainer.

The requirements to become an Associate Home Inspector are the following:

1.) 75 hours of education that include the following items:

(a)  Six hours dedicated to the inspection of roofing,

(b)  Six hours dedicated to the inspection of exterior cladding system(s).

(c)  Six hours dedicated to the inspection of masonry system(s).

(d)  Nine hours dedicated to the inspection of structural system(s).

(e)  Nine hours dedicated to the inspection of electrical system(s).

(f)   Nine hours dedicated to the inspection of plumbing system(s).

(g)  Nine hours dedicated to the inspection of heating and air conditioning systems.

(h)  Six hours shall be dedicated to the 266 CMR regulations including the standards of practice.

(i)   Six hours dedicated to Report writing.

(j)   Three hours dedicated to professional ethics.

(k)  Three hours dedicated to contract law.

 

To meet the total number of hours required, the Trainee shall select, at his/her option, any three additional open Training Credits.

2.) Complete 25 inspections under the supervision of a licensed Massachusetts home inspector
2.) Successfully pass the National Home Inspector Exam
3.) Obtain $250,000 of errors and omissions insurance and apply for the associate home inspectors license.
After becoming an Associate Home Inspector you must complete an additional 100 home Inspections under the direction of a licensed Home Inspector for a period of one year, and then apply for the Home Inspector License.

Massachusetts has reciprocity with the state of
Connecticut. Massachusetts General Laws Chapter 112 s 224 states "Upon payment to the Board of a fee and the submission of a written application provided by said Board, the Board shall issue a home inspector license to a person who holds a valid license or registration issued by another jurisdiction which has standards substantially equivalent to or exceeding the standards of the Commonwealth, as determined by said Board."

Massachusetts requires 12 hours of continuing education per licensing period.

The Board does not accept Correspondence or Online courses for Prelicensing or continuing education.

Due to the recent passing of Senate Bill 212, signed by the Governor of New Hampshire, home inspectors must fulfill the following to become a licensed home inspector:

1.       Complete 80 hours of home inspection education approved by an as yet unnamed home inspection board.

2.       Complete 20 hours of continuing education per 2 year license cycle.

Home inspectors who have been practicing for at least 12 months would be exempt from having to complete the 80 hours of pre-licensing education.

New Jersey

Legislative Summary
Effective February 14, 2006, individuals are no longer required to apply as Associate Home Inspectors.  Instead, candidates can submit an application for Home Inspector after successful completion of a home inspection program consisting of a 180 hour curriculum, of which 40 hours will be dedicated to completing home inspections under the direct supervision of a licensed Home Inspector of the school.  Candidates must also pass an examination administered and approved by the Home Inspection Advisory Committee.  Correspondence Courses are not accepted for Pre-licensing education but they are accepted for continuing education as long as approved by the Board. 

The board requires 40 hours of Continuing Education. NJ board only accepts 10 hours of correspondence education per biennial renewal.

New York

Legislative Summary
New York Licensure (Chapter 461 of the Laws of 2004) The "Home Inspector Professional Licensing Act" http://www.nysahi.com/S06100.html takes effect December 31, 2005 and requires that all home inspectors obtain a license. Home inspectors will be licensed for two years and must pay an initial fee of $250.00 and renewal fees of $100.00 thereafter. The basic provisions of the law include requirements for obtaining a license, including classroom education and on site inspection training, confirmation of an appropriate knowledge base via testing, the development of a required standard of practice and code of ethics, continuing education requirements for license renewal, and a duty of care of all license holders to the client. There are two routes to obtaining a license. An applicant must complete 140 hours of approved training, including 40 hours of unpaid inspection experience under the direct supervision of a licensed inspector, or have 100 hours of paid or unpaid inspection experience under the direct supervision of a licensed inspector. The applicant must also pass an approved written exam. Additionally, there are grandfathering provisions in the law that recognize the value of prior experience. To receive a license under this provision, an inspector must have inspected at least 100 homes within the last two years and pass an approved exam (currently believed to be the National Home Inspector Exam, www.homeinspectionexam.org), or have inspected at least 250 homes for compensation and have been a practicing inspector for at least three years, prior to the enforcement of this law.

Continuing Education:
Any licensee who will renew on or before 12/30/08 will only be required to complete 6 hours.  Renewals after 12/31/08 will require 24 hours of continuing education.

North Carolina

Legislative Summary
To be licensed as a home inspector, an applicant must do all of the following: 1) submit a completed application to the Board; 2) Pass a licensing exam prescribed by the Board; 3) Have a minimum net assets or a bond in an amount not less than $5,000 nor more than $10,000; 4) Pay the applicable fees; 5) Meet one of the following three conditions.
a) Have a high school diploma or its equivalent, have been engaged as a licensed associate home inspector for at least 1 year and have completed 100 home inspections for compensation; b) Have education experience the Board considers to be equivalent to that required by subpart (a) of this subdivision; c) Be licensed as a general contractor, architect or professional engineer.
To be licensed as an associate home inspector, a person must do all of the following:
1) Submit a completed application to the Board; 2) Pass a licensing exam prescribed by the Board; 3) Pay the applicable fee; 4) Have a high school diploma or its equivalent; 5) Be employed by or affiliated with or intend to be employed by or affiliated with a licensed home inspector and submit sworn statement by that licensed home inspector certifiying that the licensed home inspector will "actively supervise and train the applicant."

12 hours of Continuing Education are required for license renewal and must be taken in a live classroom setting. Correspondence and online courses are not approved.

Legislative Summary

The Residential Real Estate Transfers law, which went into effect in December 2001, was intended to ensure a certain level of professionalism in the work performed by home inspectors-providing guidelines and requirements to regulate the performance of home inspectors within Pennsylvania.

Highlights of the Residential Real Estate Transfers Law:

  • Home inspectors are required to be a full member in good standing of a national, not-for-profit home inspection association or must be supervised by someone who is.
  • Members must comply with a code of conduct and attend continuing professional education classes as an ongoing condition of membership.
  • Home inspectors are prohibited from performing repairs on the same house he/she inspected within the preceding 12 months.
  • Home inspectors must maintain insurance against errors and omissions and general liability coverage.
  • Violations of this law amounts to a violation of Pennsylvania's Consumer Protection Law.

South Carolina

Legislative Summary
Any person desiring to be licensed with examination as a home inspector, shall file with the commission an application of forms showing that he/she:
1) Has a minimum of one year experience as a home inspector under the direction or direct supervision of a licensed home inspector, residential builder, general contractor, engineer or architect; or
2) Has successfully completed a formal course of training in home inspection approved by the commission. 
Upon filing a completed application and copy of required fees, the applicant shall be entitled to take the home inspectors licensing exam as prescribed by the commission. Upon successful completion of the exam and payment of the licensing fee, the commission will issue a license authorizing the applicant to engage in the business of home inspection. The license is renewable bi-annually.

Tennessee

Legislative Summary
Any person who applies for licensure as a home inspector must submit an application on a form as prescribed by the commissioner. The application shall be accompanied by the fee specified in Section 4. Applicants shall furnish evidence satisfactory to the commissioner that the applicant: 1) is at least 18 years old, 2) has graduated from high school or earned a GED certificate, 3) has not been convicted of a crime that has a direct bearing on the applicant's ability to perform competently and fully as a licensed inspector, 4) is not the subject of a disciplinary or enforcement action by another state or a local jurisdiction in connection with the performance of home inspections or the licensing or certification of home inspectors, 5) has successfully completed 90 hours of a commissioner-approved training program or course of study involving the performance of home inspections and the preparation of home inspection reports, 6) has passed a commissioner-approved competency examination administered by the state or an entity selected by the state, and 7) has obtained a certificate of insurance in an amount required by the commissioner for general liability as well as errors and omission to cover all activities contemplated under this chapter.
During the first 180 days after the effective date of this act (July 1, 2006), the commissioner may issue a license to an applicant who meets the requirements stipulated in the law if the applicant furnishes evidence satisfactory to the commissioner that the applicant: 1) has been principally engaged in the performance of home inspections in this state for at least two years, and 2) has complete at least 150 home inspections for compensation in the applicant's career.

Continuing Education requirement: 32 hours of CE every two years.

Texas

As of the October 8, 2007, TREC has amended its inspector licensing requirements under the Fast Track method:

Education Requirement:
328 education hours acceptable to the commission.

Experience Requirement:
Approved experience training module of at least 120 hours from an approved education provider; or
accompanying a licensed professional inspector for at least 120 hours on actual inspections and related work and having that licensing inspector certify such attendance; Or at least 5 years of personal experience in a field directly related to home inspecting, including but not limited to installing, servicing, repairing or maintaining the structural, mechanical and electrical systems found in improvements to real property

As of September 1, 2007, home inspectors must provide proof of liability insurance to obtain or renew a license. The liability insurance must provide coverage at a minimum of $100,000 per occurrence. 

Continuing Education Requirements:  16 hours of commission-approved core/continuing education real estate inspection courses per year

Effective September 1, 2011 real estate inspectors must complete 32 classroom hours of TREC approved continuing education real estate courses, 6 hours of which must be in the Texas Standards of Practice/Legal/Ethics Update course.

Every applicant for an individual home inspector certificate shall have the following

qualifications:

1. The applicant shall be at least 18 years old.

2. The applicant shall meet the following educational and experience

(1) Completed 35 contact hours of classroom instruction and

have completed a minimum of 100 home inspections; or

(2) Completed 70 contact hours of classroom instruction and

have completed a minimum of 50 home inspections.

Since the Board for Asbestos, Lead, and Home Inspectors does not have the statutory authority to approve home inspectors training courses, any “classroom” instruction that covers the areas tested on the National Home Inspectors Examination will be accepted to meet the entry requirements as described in Board Regulation 18 VAC 15-40-30 for Certified Home Inspector. Those contact hours of instruction that cover topics other than the areas tested on the National Home Inspectors Examination will not be accepted.

 

Please note that correspondence courses (home study courses) and on-line courses (internet courses) cannot be accepted. The Board was very specific in requiring "classroom" instruction. The Board felt that the student/instructor interaction, as well as hands-on training, was necessary.

 

The Board-approved exam is administered by the Examination Board of Professional Home Inspectors (EBPHI). For information regarding the examination and the content areas tested, please review their web site:

Washington

Legislative Summary
Beginning September 1, 2009, an individual must obtain a license to perform home inspections in the state of Washington.  Individuals have until July 1, 2010 to meet the licensing requirements. 

Qualifications for licensure: In order to become licensed as a home inspector, an applicant must submit the following to the department:
1.) Application form
2.) 120 hours of approved education
3.) Up to 40 hours of field training supervised by a licensed home inspector
4.) Pass written exam

**If a person has been performing the duties of a home inspector for at least 2 years and has performed at least 100 inspections, he or she must apply to the board before September 1, 2009. 

Continuing education: 24 hours every 2 years

West Virginia

Legislative Summary
Effective August 1, 2006, any person performing or engaged in home inspection work for compensation must possess a certificate issued by the West Virgina Fire Marshal. To qualify
for certification, applicants must:  a) pass the NHIE** offered by the Exam Board of Professional Home Inspectors or NAHI State Exam; b) shall either present proof of having conducted business as a home inspector for three years prior to the effective date of this rule, or proof of satisfactory completion of at least eighty (80) hours of instruction and complete and pass the course exam which has been approved by the State Fire Marshal; c) successfully completed high school or its equivalent; d) present proof of and maintain general liability insurance in the amount of $250,000.  Please go to www.firemarshal.wv.org for additional details. Continuing Education requirement is 16 hours per year.

1) Complete the application for home inspector examination or the retake application and all required documentation. 2) Successfully complete the State examinations for registration. 3) Complete the application for registration as a home inspector and all required documentation. Biennial renewal due by Dec 31 of even numbers. Continuing education requirements - 20 hours each year.
